Petition filed under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition and grounds thereof, the High Court may be pleased to enlarge the petitioner on bail in connection F.I.R.No. 79 of 2016 on the file of P.S. Kothakota, Mahabubnagar District in the event of their arrest in the interest of justice.

The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Rajagopallavan Tayi, Advocate for the Petitioners and the Addl. Public Prosecutor(TS) for the Respondent-State, the Court made the following ORDER :- "This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioners/accused, seeking anticipatory bail in the event of their arrest in connection with F.I.R. No.79 of 2016, on the file of Kothakota Police Station, Mahaboobnagar District, registered for the offences under Sections 406, 409, 420, 468, 471 and 109 of I.P.C.

Heard the learned counsel for the petitioner/accused, learned Additional Public Prosecutor appearing for the respondent-State, and perused the record.

The specific allegation leveled against the petitioners is that they aided in disbursing the amounts under the Government scheme of 'Kalyana Lakshmi'.

As per the Government's scheme of 'Kalyana Lakshmi' an amount of Rs.51,000/- is being given by the State Government to the brides coming from below poverty line, at the time of their marriages. The petitioners are the Revenue officials working in different capacities. One similar criminal case was also registered against the petitioners. Though there is an accusation against the petitioners that they have indulged in disbursing the money under the Government scheme of 'Kalyana Lakshmi' without adverting to the regulations framed there under, there is no specific mention of the roles played by the petitioners, constituting the aforesaid offences. The actual role played by each of the petitioners is yet to be established. The petitioners are permanent employees having permanent residences. Contd.2...

- 2 - Having regard to the nature of allegations, the petitioners/accused can be enlarged on bail on some conditions. Accordingly, the petitioners/accused are directed to surrender before the Station House Officer, Kothakota Police Station, Mahaboobnagar district, within 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioners/accused on bail, each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. On release, the petitioners/accused are directed to attend before the Station House Officer, Kothakota Police Station, on every Sunday between 09:00 and 10:00 a.m. till filing of charge sheet. Further, the petitioners/accused are directed to abide by the conditions mentioned under Section 438(2) Cr.P.C. and shall co-operate with the Investigation Officers. Accordingly, with the above directions, the Criminal Petition is allowed. In consequence, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. "
