THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6810 of 2016 ORDER:

This Criminal Petition is filed by the petitioners-A.1 to A.4 under Section 482 Cr.P.C., to quash the proceedings in Crime No.203 of 2015 on the file of Ponnur Urban Police Station, Guntur District for the offences under Sections 323, 354, 506 IPC and Section 3(1)(x)(xi) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. Heard.

On perusal of the entire material available on record, prima facie there are certain allegations as against the petitioners herein and truth or otherwise of the said allegations can be ascertained by the investigating agency during the course of investigation and this Court is not inclined to quash the proceedings in the said crime at the threshold. At this stage, learned counsel for the petitioners submitted that some of the accused-petitioners were already arrested and in view of the pendency of the above crime, the remaining accused apprehend arrest and also harassment in the hands of the police.

In view of the above, the police concerned are directed to complete the investigation into the crime without arresting the petitioners herein and file a final report, if any, in accordance with law. The petitioners are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

Accordingly, the Criminal Petition is disposed of. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 28.04.2016.
