THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.21214 of 2014 ORDER:

There is no representation on behalf of the petitioners. 2.

The prayer sought in the writ petition is as under:- "...to issue a Writ of Mandamus or any other appropriate writ declaring that the action of the respondent police in freezing the bank accounts of the petitioners namely, a) Current Account of the 1st petitioner bearing No.913020020668137, Axis Bank, Begumpet Branch, Hyderabad b) Current Account of the 2nd petitioner vide A/c.No.370601010036348, Union Bank of India, Saifabad Branch, Hyderabad, Savings Bank account of the 3rd petitioner bearing No.62227996080, State Bank Hyderabad, Nagole Branch, Hyderabad in the purported investigation of the crime in FIR No.33 of 2014 dated 15.02.2014 and thereby depriving the petitioners to operate the bank accounts, is arbitrary and illegal and consequently direct the respondents to de-freeze the said bank accounts of the petitioners and thereby enabling the petitioners to operate the bank accounts and grant such other relief as it deems fit in the circumstances of the case." 3.

The 2nd respondent filed a counter-affidavit denying the allegations made in the affidavit filed in support of the writ petition and contended inter alia that in compliance with the orders passed by this Court in W.P.M.P.No.26602 of 2014, the Investigating Officer addressed letters to the Banks vide C.No.1059/C33/CID/2014, dated 30.08.2016, to defreeze the accounts, which were freezed at the time of investigation. Pursuant to the said letters, the concerned Banks have de-freezed the accounts as mentioned in the counter-affidavit, which are as follows:

"1.

State Bank account No.62227996080, State Bank of India, Nagole branch, Hyderabad, was defreeze on 01.09.2006 and present status is inactive due to not operating the account.

2.

Union bank account No.370601010036348, Saifabad Branch, Hyderabad, was defreeze on 30.08.2016 and present statues is active.

Axis bank account No.913020020668137, Begumpet Branch, Hyderabad, was defreeze on 31.08.2016 and present statues is freeze in the account on 27.09.2017 due to Ministry of Corporate Affairs of India struck off." It is also further mentioned in the counter-affidavit that the Investigating Officer after completion of investigation filed charge sheet. Presently the case is under trial vide C.C.No.313 of 2018. 4.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
