Petitioner And Southern Power Distribution of AP Ltd., Rep., by Asst. Divisional Engineer (OPS), Rajampet, Kadapa District. & others.

.. Respondents This court made the following :

- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40171 OF 2018 ORDER :

Heard learned counsel for the petitioner, Sri N. Siva Reddy, learned Standing counsel for respondents 1 and 2 and learned Government Pleader for respondent No.3. 2.

Petitioner is aggrieved by change of name in the electricity power supply connection bearing S.Nos.2324335000994 and 2324335000997. The material on record would disclose that after the demise of father of petitioner, the service connection was changed in the name of mother of the petitioner. Petitioner filed O.S.No.28 of 2017 pending on the file of Chief Judge, City Civil Courts, Hyderabad, praying to grant decree of partition of the plaint schedule properties into three equal shares and the said suit is pending.

3.

Though petitioner has already instituted suit for partition and the same is pending consideration, on the ground that there was change of name in the electrical power supply connection in the name of his mother made prior to September, 2015, this writ petition is filed seeking declaration that change of name in favour of the 5th respondent as arbitrary.

4.

Since a civil litigation is pending, this Court is not inclined to entertain the writ petition which is filed three years later, for change of name in the electrical power supply connection.

- 3 - 5.

Thus, leaving it open to the petitioner to work out his remedies in the pending suit, the Writ Petition is dismissed. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 9th November, 2018 Rds
