THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41647 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in interfering in the civil disputes relating to petitioner's plots bearing Nos.28, 29, 30, 31, 32 and 33 in survey No.124/A admeasuring 1200 sq yards situated at Gopanapally Village, Serilingampally Mandal, Ranga Reddy District and threatening to implicate the petitioner in false criminal case without any authority or jurisdiction as illegal and arbitrary.

Heard and perused the material.

Learned counsel for the petitioner submits that the third respondent is interfering with the possession and enjoyment of the petitioner's property at the instance of the land grabbers and as such, seeks a direction to the third respondent not to interfere with the possession and enjoyment of the petitioner's property.

Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the petitioner's possession and enjoyment of his property.

Considering the rival submissions of the learned counsel for the petitioner and the Assistant Government Pleader for Home (Telangana), and also considering the facts and circumstances of the case, the third respondent is directed not to call the petitioner to the police station and also not to interfere with the petitioner's possession and enjoyment of his property mentioned above. The third respondent is also directed to follow due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 30.11.2016 pln
