The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10756 of 2017 Order:

This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioners/accused Nos.1 to 4, seeking anticipatory bail in the event of their arrest in connection with Crime No.251 of 2017, on the file of the Saroornagar Women Police Station, Rachakonda, registered for the offences punishable under Sections 498-A, 506, 406 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. Heard the learned Counsel for the petitioners, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.

It is conceded by both the learned Counsel that this matter can be referred to the concerned Family Welfare Committee for its interaction with the parties and filing report in terms of the directions given in Rajesh Sharma and others vs. State of U.P. and another1.

Accordingly, relying upon the latest two-Judge Bench expression of the Apex Court, dated 27-07-2017, in Crl.A.No.1265 of 2017 (SLP (Crl.) No.2013 of 2017) in Rajesh Sharma Supra, the matter is directed to be referred by the learned jurisdictional Magistrate to the Committee to be constituted for reconciliation 1 2017 (2) ALT (Crl.) 393 (SC)

Dr.SA, J Crl.P.No.10756 of 2017 Dt: 14-11-2017 and settlement and in a contra situation, to proceed with the trial of the matter on merits. The petitioners shall not be arrested till a report is filed by the Committee.
