THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11675 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not issuing the promotion orders to the petitioner to the post of Assistant 10 - B pursuant to the Notification dated 28.10.2015 for departmental promotion, as illegal, and contrary to the order of this Hon'ble Court dated 10-04-2014 in WP 10546 of 2014, and discriminatory, which is violation of Article 14 of the Constitution of India, and consequently direct the respondents to issue promotion orders to the petitioner to the post of Assistant 10-B."
Heard Sri V.R. Machavaram, learned counsel for the petitioner and Sri B. Raj Kiran, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 2302-2016 to the 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 3rd respondent to pass appropriate orders on the representation, dated 23-02-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be considered, in accordance with law.
Recording the said submission, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 23-02-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
