THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11469 OF 2017 ORDER:

This petition is filed under Section 439 Cr.P.C. to grant bail to the petitioners-A5 and A6 for the offences alleged under Sections 120-B, 302 and 379 r/w 34 IPC. 2.

Heard learned counsel for the petitioners-A5 and A6, learned Additional Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners-A5 and A6 would submit that the petitioners-A5 and A6 are in judicial custody for more than 50 days. The prosecution case is false. They have nothing to do with the death of Darmavaram Suryakanth (hereinafter referred to as 'the deceased') and ultimately, prayed to allow the petition. 4.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioners-A5 and A6. 5.

As per the material placed on record, A5 hatched criminal conspiracy to kill the deceased to avoid payment of Rs.11,00,000/- and succeed his property as the deceased was not having children. The petitioners-A5 and A6 narrated their plan to kill the deceased to juvenile No.1A1. Juvenile No.2-A2 was engaged by offering Rs.3,00,000/- and ultimately, Juvenile Nos.3 and 4-A3 and A4 in that process, caused the death of the deceased on 15.09.2017.

The allegations are grave. The investigation is in progress. Release of the petitioners-A5 and A6 would hinder the investigation and cause disappearance of the

evidence. Therefore, the petition is devoid of merit and is liable to be dismissed.
