HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10922 of 2017 ORDER :

Before admission and before notice to the 2nd respondent, heard the learned counsel for the petitioners/A.1 to A.7 in C.C.No.326 of 2017 on the file of the XIV Metropolitan Magistrate, Cyberabad at L.B.Nagar, where the learned Magistrate has taken cognizance for the offences punishable under Sections 498-A, 324 and 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act, which is out come of the private complaint of the de facto complainant referred by the learned Magistrate to police for investigation in registration of Crime No.36 of 2017 by the Station House Officer, Women Police Station, Saroornagar, and after investigation filed the charge sheet.

From perusal of the material on record, there is nothing for the Court to order notice or keep the matter pending to quash the proceedings, but for left open all defences including, if necessary, by filing any application for discharge, for the learned Magistrate to consider on own merits. From the difficulty expressed for all to appear before the trial Court, remedy is left open, by virtue of this order, to the petitioners to approach the learned Magistrate under Rule 37 of the Criminal Rules of Practice for permitting by learned Magistrate on such application for one to represent the others after hearing and with necessary condition including undertaking to appear as and when required personally.

With the above observations, the criminal petition is disposed of.
