THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.991 of 2014 ORDER:

The petitioners appeared for the recruitment process for the post of Assistant Professor in Department of Physics, pursuant to Notification Nos.04/10, 05/10 and 06/10, dated 09.09.2010. In Physics Department, about fifteen (15) number of posts were notified and the qualifications prescribed was that one must possess good academic record as defined by the University with at least 55% marks at Master's Degree level or equivalent Degree or one should have a Ph.D., Degree, in accordance with the University Grants Commission (Minimum Standards and Procedure for Award of Ph.D Degree) Regulations, 2009. The petitioners appeared for interview on 15.09.2012 and when results were not declared, the present Writ Petition was filed.

A counter-affidavit is filed admitting conduct of interviews from 14th to 18th September, 2012. However, the Executive Council in its 129th Meeting held on 02.07.2013, resolved to constitute a Sub-Committee consisting of three members to examine each and every case of recommendation made by the Selection Committee and to submit a report. The Executive Council in its meeting held on 03.09.2013 resolved to approve all recommendations of the Selection Committee and the report of the Sub-Committee for appointment under limited recruitment (SC/ST backlogs), unfilled vacancies and General Recruitment for the appointment of Associate/Assistant Professors and issue appointment orders to them. It was further resolved not to approve the selection of Assistant Professors in Physics for the

category of OC (W), BC-A, and OC (W) and directed the University to re-notify the vacancies. Thus, the results of the petitioners were not declared since the selection was not approved. 3.

When the matter was taken up for consideration, it was suggested to learned counsel Standing Counsel for the respondentUniversity, to declare results of the petitioners, without having the right of consequence. Learned Standing Counsel for the respondent-University, on the basis of instructions from the Officers concerned, agreed to declare the results of the petitioners. In view of consent given by learned Standing Counsel for the respondent-University, the respondent is directed to declare the results of the petitioners, within a period of two weeks from the date of receipt of a copy of this order.
