HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION Nos. 40328, 40192 & 40209 of 2018 COMMON ORDER:
1) Heard learned counsel for the petitioners and Sri N.Praveen Kumar, learned Standing Counsel for respondent No.2. With their consent, the writ petitions are disposed of at the admission stage. 2) Since the issue involved in the three writ petitions is one and the same, they are disposed of by this common order. 3) These writ petitions came to be filed seeking issuance of writ of mandamus declaring the impugned notices Roc.No.F/987/2018, dated 03.07.2018, issued by the second respondent and the notices Rc.No.B/442/2018, Dated 12.07.2018, issued by respondent No.3, in respect of the subject water plants, as illegal and arbitrary. 4) Though various grounds are raised, learned counsel for the petitioners submits that without giving an opportunity of submitting explanation or explaining their stand, the impugned notices came to be issued ordering stoppage of water plants.
5) The learned Standing Counsel would submit that treating the notices dated 03.07.2018 as show cause notices, the petitioners may submit their explanation, in which event, the authorities would deal with the same, in accordance with law.
6) Having regard to the above circumstances, the writ petitions are disposed by directing the petitioners to submit their explanations by treating the notices dated 03.07.2018 as show cause notices, enclosing necessary documents, in which event, the authorities concerned shall pass orders, in accordance with law, after hearing all the concerned. Till such time, status-quo as on today, to be maintained with regard to the subject plant.
