Smt. M.Vani, W/o. M.Ravinder Reddy Petitioner (Accused No.6 in Cr.No.683/2017 Saroornagar P.S., Rachakonda Commissionerate) AND The State of Telangana, rep. by its Public Prosecutor, High Court, Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Saroornagar Police Station to release the Petitioner on bail in the event of her arrest in connection with Crime No. 683 of 2017 of Saroornagar Police Station. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri N.Harinath, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:

" This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A6 for the offences alleged under Sections 406, 420 and 506 r/w 34 IPC and 5 of APPDFEA and 4 and 5 of PC & MC Banning Act. 2.

Heard learned counsel for the petitioner-A6, learned Additional Public Prosecutor representing the State and perused the record. 3.

Learned counsel for the petitioner-A6 would submit that the petitioner-A6 is the sister-in-law of A.Konda Reddy-A1. There is no specific mention against the petitioner-A6 indulging in chit business or collecting any amount from the alleged depositors of chit amounts. The petitioner-A6 is in no way directly or indirectly connection with the alleged chit business conducted by A1 and A5. The petitioner-A6 is unnecessarily roped in this litigation and ultimately, prayed to allow the petition.

On the other hand, learned Additional Public Prosecutor would submit that the properties purchased by A.Konda Reddy and others were invested in the name of the petitioner-A6. A3 and A6 are own sisters and they executed sale deeds and G.P.A.

The matter is heard at length. In the course of hearing, the learned Additional Public Prosecutor could not bring a single instance of the petitioner-A6 acknowledging the receipt of money from any of the depositors or whether the petitioner-A6 agreed to pay any amount alleged to have been collected by A1 and others to the so-called depositors. There is no single paper shown that the petitioner-A6 is directly or indirectly involved in the alleged chit business said to have carried by A1 and A5.

It is brought to the notice of this Court that the petitioner-A6 is a teacher working in Z.P. High School, Ibrahimpatnam. Her presence can be procured easily at any time.

Having regard to the nature of allegations and the material collected so far, the petitioner can be enlarged on bail under Section 438 Cr.P.C.

In the result, the Criminal Petition is allowed directing the petitionerA6 to surrender before the Station House Officer, Saroornagar Police Station, Rachakonda District, within 15 days from the date of this order. On such surrender, the said S.H.O. shall release the petitioner-A6 on bail, on petitioner-A6 executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to his satisfaction. On release, the petitioner-A6 shall abide by the conditions mentioned under Section 438 (2) Cr.P.C. The petitionerA6 shall attend before the S.H.O. concerned, on every Sunday between 8.00 A.M. and 10.00 A.M. till filing of charge sheet."
