THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.10759 OF 2017 ORDER:

This petition is filed by the petitioner-A8 under Section 482 Cr.P.C. to permit the petitioner to make his appearance through his counsel as contemplated under Section 205 Cr.P.C.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

The alleged offences are triable by the Court of Session. Section 205 Cr.P.C. empowers the Magistrate to allow the accused to be represented by an Advocate, such arrangement cannot be made in the proceedings pending before the Court of Session. Therefore, the petition is devoid of merit and is liable to be dismissed. However, the petitioner-A8 is at liberty to file an application to dispense with his personal attendance as and when he chooses to do so. On filing such an application, the court below may consider the same in accordance with law.

With the above observation, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
