THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28098 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "....to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd and 3rd respondents in not registering a case against the respondent No.4 and 5 as per the complaint of the petitioner dt.25.7.2014 as illegal, arbitrary and violative of principles of natural justice and violative of Articles 14 and 21 of the Constitution of India and consequently to direct the respondents No.2 and 3 to register a complaint against the respondent No.4 and 5 by considering the petitioner's complaint dt.25.07.2014 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Government Pleader appearing for the respondents 1 to 3 brought to the notice of this Court that pursuant to the complaint lodged by the petitioner on 25.07.2014, a case in Crime No.439 of 2014 was registered on 23.09.2014 and the matter was under investigation.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
