HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P. No. 306 of 2016 ORDER:

This petition is filed to transfer O.P.No.28 of 2015 from the file of Senior Civil Judge, Kandukur, Prakasham District, to Senior Civil Judge, Bodhan, Nizamabad District.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 18.08.2014 as per Hindu custom and that the marriage was not consummated.

She stated that respondent started harassing her on petty reasons and that parents of respondent started her torturing both mentally and physically and that she tolerated the same for some time and thereafter respondent and his family members pressurized her to bring additional dowry, due to which she is living separately. She stated that respondent filed O.P.No.28 of 2015 before Senior Civil Judge, Kandukur and that she is resident of Bodhan, Nizamabad District and distance between these two places is more than 500 kms. She stated that she has to incur nearly Rs.2,000/- towards food and boarding besides bus fair of Rs.1,200/- for one person and she has to be accompanied by a male person, therefore in total she has to spent Rs.5,000/- for each date of hearing besides advocate fee. She stated that it is difficult for her to meet such travelling expenses

and that she is a poor lady depending on the mercy of her father, who is working as mason, for these reasons, she prayed for transfer of O.P.No.28 of 2015 from Senior Civil Judge, Kandukur to Senior Civil Judge, Bodhan.

This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due and in compliance of the said order, advocate filed memo on 23.06.2016 stating that notice sent to respondent was duly served and along with memo postal receipt and original postal acknowledgment are filed. In spite of service of notice respondent neither appeared in person nor through any advocate.

4. Heard arguments.

Considering the reasons stated in the affidavit filed in support of petition and also considering the convenience wife, O.P.No.28 of 2015 is withdrawn from Senior Civil Judge, Kandukur, Prakasham District, and transferred to Senior Civil Judge, Bodhan, Nizamabad District, for disposal in accordance with law.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
