HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24316 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring orders vide Rc.No.1005/2016/B1, Dt.10.06.2016 passed by the 3rd respondent in suspending the petitioner's F.P. shop authorization on flimsy grounds contrary to the Andhra Pradesh State Public Distribution (Control) Order, 2008, without conducting any enquiry and without affording any opportunity is illegal, arbitrary and consequently by setting aside the same direct the respondents to continue the petitioner as Shop No.15 Seegalapalli Village, Kundurpi Mandal, Anantapur District and release the stock continuously.
2. Heard the learned counsel for the petitioner and learned Assistant Government Pleaders for Civil Supplies (A.P.).

The case of the petitioner is that the third respondent suspended the authorization of the petitioner on 10.6.2016 on the ground that the petitioner has committed irregularities in distribution of essential commodities to the card holders. A perusal of the record reveals that the proceedings are pending before the third respondent.
4. Taking into consideration the facts and circumstances of the case, the third respondent is hereby directed to dispose of the proceedings pending before him as early as possible preferably within a period of one month from the date of receipt of a copy of this order, failing which the authorization of the petitioner may be restored.
5. With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
