THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.12289 of 2016 ORDER :

The present Criminal petition is filed seeking relaxation of the conditions imposed in Crl.M.P.Nos.1444 of 2016 in Crime No.68 of 2016 on the file of the Metropolitan Sessions Judge-cum-Special Judge to try the offences under Narcotic Drugs and Psychotropic Substances Act, 1985. Act, Visakhapatnam.

By an order, dated 29.06.2016, passed in Crl.M.P.Nos.1444 and 1573 of 2016, the Metropolitan Sessions Judge-cum-Special Judge to try the offences under Narcotic Drugs and Psychotropic Substances Act, 1985. Act, Visakhapatnam, while releasing the petitioner on bail, directed the petitioner to execute personal bond for a sum of Rs.10,000/- with two government sureties for a like sum each. Out of which one surety from the native place of the petitioners and one surety from Visakhapatnam. Learned counsel for the petitioners submits that though the bail was granted on 29.06.2016 till date the petitioner could not get himself released.

Having regard to the facts and circumstances of the case and in view of the earlier order passed by this Court in Crl.P.No.11152 of 2016 the request of the petitioners can be considered to the extent of furnishing Government Sureties.

Accordingly, the Criminal Petition is allowed, the order dated 29.06.2016 passed in Crl.M.P.Nos.1444 of 2016 is modified and the petitioners shall be released on bail on executing personal bond for a sum of Rs.10,000/- with two sureties for a like sum each. Out of which one surety must be from the native place of the petitioners and

one surety from Visakhapatnam. The other conditions shall remain un-altered.
