CVNR, J & KVL, J WA.No.34252 of 2017 Dated:13.10.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The petitioner, whose appeal filed against his nonpromotion is pending before respondent No.1, filed Original Application No.1333 of 2017 before the Andhra Pradesh Administrative Tribunal at Hyderabad (for short 'the Tribunal') for the same relief as was claimed in the appeal. The Tribunal has taken exception to this prayer and dismissed the said O.A. by order, dated 01.6.2017, without even granting the lesser relief of a direction to respondent No.1 to dispose of the appeal filed by the petitioner.

Mr. A.Sreedhar, learned counsel for the petitioner, submitted that though in form, the relief claimed by the petitioner in the said O.A. is similar to that claimed in the appeal, his client would be content if a direction to respondent No.1 is given for early disposal of the appeal filed by him. Learned Government Pleader for Services (Andhra Pradesh) fairly submitted that there can be no objection for early disposal of the appeal by respondent No.1.

In the above facts and circumstances of the case, the Writ Petition is disposed of, with the direction to respondent No.1 to dispose of the appeal stated to have been filed by the petitioner, against his non-promotion, as expeditiously as possible, and not

As a sequel, WPMP.No.42718 of 2017 stands disposed of as infructuous.
