lA NO: 3 OF 2016 (cRLRCMP.No.a426 of 201 6l Petition under Section 399 & 401 of CR.P.C, praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant bail to the petitioner/accused in the Crl.Rc.No.2100 of 2016 on the file of the this Hon'ble Court by suspending the sentence awarded in Crl.A.No. 963/2014 dated 16.05.2016 passed by the learned Addl. Metropolitan Sessions judge for trial of

communal offences cases - cum- VII Addl. Metropolitan Sessions Judge at Nampally, Hyderabad which confirmed the judgment passed in CC no.473l213 (old Cc No.745l213) on the file of the XXV Spl. Magistrate, Erramanzil, Hyderabad pending disposal of the main Crl.Rc., Pending disposal of CRLRC 2100 of 20't6, on the file of the High Court.

The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri P.BHAKTHAVATSAL, Advocate for the Petitioner, PUBLIC PROSECUTOR for the Respondent No.1 and the Court made the following. ORDER:

There was no representation on behalf of the petitioner on 22-'10.2024, 29.10.2024 and 22.11.2024. Therefore, this Court directed the Registry to list this matter on 29.11.2024 under the caption, "for dismissal". Even today, there is no representation on behalf of the petitioner. Learned Assistant Public Prosecutor is present. This Court vide order dated 11.08.2016 suspended the imprisonment imposed on the petitioner alone pending Revision and directed him to be released on bail on his executing a personal bond for a sum of Rs.10,000/- with two sureties for a like sum each to the satisfaction of the learned XXIV Special Magistrate, Erramanjil, Hyderabad.

The petitioner filed another application vide Crl.R.C.M.P.No.4426 of 2016 stating that the petitioner was arrested by the Police concerned on 08.11.2016 in execution of NBWs and that he was produced before the learned Vll Additional Metropolitan Sessions Judge, Nampally, Hyderabad. Again this Court vide order dated 09.11.2016 granted bail to the petitioner on his executing a bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction of the learned XXV Special Magistrate, Erramanzil, Hyderabad.

Under these circumstances, the order dated 09.11.2016 passed by this Court, enlarging the petitioner on bail, stands revoked. As the Special

Magistrate Courts are abolished, the competent criminal Court is directed to issue NBWs against the petitioner in C.C.No.473 of 2013 (old C.C.No.745 of 2013) and take consequential measures in accordance with law.
