- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40310 OF 2018 ORDER :

Heard learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing counsel for respondents. 2.

Petitioner claims to own building bearing H.No.3-6/52/A on plot No.88 of Gopanpally Village, Serlingampally Mandal, Ranga Reddy District. To the said premises, the respondents provided electricity power supply connection bearing S.C.No.1100401354. By letter dated 09.05.2018, petitioner was asked to pay an amount of Rs.2,51,080/-, alleging that the premises is used for non-domestic purpose i.e., by establishing hostel. In the notice it is clearly mentioned that if the petitioner is agreeing, he can pay the amount within 15 days or if he has grievance, he may prefer appeal to the next higher authority within 15 days from the date of service of notice. Admittedly, so far, no appeal is filed.

3.

Learned counsel for the petitioner sought to contend that the notice dated 09.05.2018 was served only on 02.11.2018. If what is said is correct, fifteen days time is still available to the petitioner. No reason is assigned as to why petitioner has not availed the remedy of appeal and straight away invoked the jurisdiction of this Court.

4.

Since the notice itself provides for remedy of appeal, the Court is not inclined to entertain the writ petition.

- 3 - 5.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioner to avail remedy of appeal.

Pending miscellaneous petitions shall stand closed.
