THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34723 of 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Mines & Geology.

According to the petitioner, he submitted an application for grant of mining lease for Laterite mineral over an extent of 14.73 Hectares in Sy.No.1 of Anumarthi Village, Sankhavaram Mandal, East Godavari District. The Tahsildar, Sankhavaram Mandal, vide Ref.B/2325/2016, dated 07.02.2016, issued 'No Objection Certificate'. The Forest Range Officer, Yeleswaram Range, Yeleswaram also addressed a letter bearing Rc.No.149/2017, dated 05.06.2017, certifying that the proposed area is 15 meters away from Sarlanka Reserved Forest. The Panchayat Secretary, Gram Panchayat, Velangi, by way of a letter, dated 26.11.2015, also expressed no objection for the mining operations in the subject area. The grievance of the petitioner, in the above background, is that, despite the said clearance granted, no final orders have been passed, on his application for grant of mining lease by the respondents herein, so far.

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the present Writ Petition, directing the second respondent to pass orders on the mining lease application of the petitioner herein, dated

09.09.2016, strictly in accordance with law, within a period of three months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous petitions, if any pending in this Writ Petition shall stand disposed of.
