Smt Nitturi Sujatha, v. The State Of Telangana,
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.7896 OF 2016 O R D E R :
Heard counsel for the petitioner and the Government Pleader for Revenue appearing for the respondents.
2. Petitioners' grievance is that he had applied to the 5th respondent on 05.10.2015 for survey of his land admeasuring Ac.0.24 guntas in survey No.192/C and Ac.0-141⁄2 guntas in survey No.193/C totally admeasuring Ac.0.38 1⁄2 guntas of Yellapur Village, Hasanparthy Mandal, Warangal District and that the 5th respondent is not taking any action, even though he had paid charges for the said survey.
3. On 03.03.2016 in W.P.No.6690 of 2016 this Court has considered the issue of survey in respect of private land, subject to collection of requisite charges, by the officials of the Survey Department.
4. Therefore, for reasons alike, this Writ Petition is also disposed of directing the 5th respondent to conduct survey by demarcating and fixing boundaries to the petitioner's land, after issuing notice to all the affected parties and after collecting necessary charges for the same, within a period of four (04) weeks from the date of receipt of a copy of this order. It is made clear that any survey conducted by the 5th respondent will not affect the right, title and interest of any third parties. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
