HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD I.A.No.3 of 2018 & Crl.R.C.No.3090 of 2018 ORDER:

I.A.No.3 of 2018 is filed under Section 147 of N.I.Act to record the compromise between the parties and allow the Criminal Revision Case by duly setting aside the judgment dated 07.03.2018 in Crl.A.No.982 of 2014 on the file of Special Judge for Trial of Offences under Scheduled Castes and Scheduled Tribes (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad.

2. Crl.R.C.No.3090 of 2016 is arising out of order dated 07.03.2018 passed in Crl.A.No.982 of 2014 by the Special Judge for Trial of Offences under Scheduled Castes and Scheduled Tribes (POA) Act-cum-VI Additional Metropolitan Sessions Judge, Secunderabad, confirming the conviction and modifying the sentence passed by the XI Special Magistrate, Secunderabad at Hyderabad in C.C.No.321 of 2013, dated 22.09.2014.

3. Heard the learned counsel for the petitioner as well as the learned counsel for 2nd respondent and the learned Public Prosecutor for the 1st respondent.

4. Sri N Ravi Varma has filed an affidavit on behalf of the 2nd respondent who is an authorised person of M/s Papillon Market Innovators (P) Ltd, Secunderabad. He stated

in his affidavit that the interested person i.e., mother of the petitioner/accused has approached the 2nd respondent and paid an amount of Rs.54,000/- (Rupees fifty four thousand only) and the matter is compromised out of the Court and requested to record the compromise and release the petitioner/accused.

5. Learned counsel for the petitioner and 2nd respondent have jointly submitted that the parties have compromised in terms of joint memo filed on behalf of the petitioner/accused by his mother and on behalf of the 2nd respondent, the authorized signatory Sri N Ravi Varma.

In view of the submissions made by both parties and in the light of Joint memo filed by them, the offence is compounded against the petitioner/accused and consequently the judgment dated 07.03.2018 passed in Crl.A.No.982 of 2014 by the lower appellate Court is hereby set aside and the petitioner/ accused is acquitted. 7.

Accordingly, I.A No.3 of is allowed.

Consequently, the Criminal Revision Case is also allowed. Miscellaneous Petitions, if any pending, shall stand closed.
