THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD Writ Petition No.38747 of 2017 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The jurisdiction of this Court is invoked seeking a mandamus to declare the action of respondents 1 to 6, in permitting the 7th respondent to mine the land in Survey No.1724 of Chinnamandem Village and Mandal, Kadapa District, contrary to Section 3 of the Environment Protection Act, 1986, as arbitrary and illegal. A consequential direction is sought to respondents 1 to 6 not to grant permission to the 7th respondent for mining the land. The representation which the petitioners submitted to the District Collector on 02.11.2015 relates only to their being denied access to the adjacent land of the 7th respondent.

As the petitioners have not even made a complaint regarding the quarrying operations of the 7th respondent to the authorities concerned, suffice it to permit them to submit a representation to both respondents 2 and 5 regarding their allegation that the 7th respondent is carrying on quarrying operations and thereby polluting adjacent lands. In case any such representation is made, respondents 2 and 5 shall consider the same in accordance with law.

The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
