THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI WRI T PETI TI ON No.33740 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The State and its police officials are before this Court by way of this writ petition aggrieved by the order dated 07.06.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.1514 of 2013.
The first respondent, the applicant in the O.A., is on caveat through Sri Mamidi Venu Madhav, learned counsel.
Perusal of the order under challenge reflects that the first respondent/applicant was dismissed from service under order dated 16.07.2011 on the sole ground that he had suffered conviction and sentence in C.C.No.6 of 2009 on the file of the Court of the learned Principal Junior Civil Judge-cum-Land Grabbing Court, Visakhapatnam. It is however an admitted fact that the said conviction was set aside in appeal in Crl.A.No.43 of 2011 on the file of the learned Principal District and Sessions Judge, Visakhapatnam. As the dismissal of the first respondent/applicant was on this sole ground which stands liquidated by virtue of his acquittal in appeal, there is no other basis to sustain the dismissal order. The Tribunal held to this effect and granted relief. We find no reason whatsoever to interfere with the order under challenge. The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
