THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.35377 of 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:
"To issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondents in not passing the orders on the application dated 18.8.2017 submitted by the petitioner society for the grant of minority status certificate to the petitioner proposed institution i.e. Hazarath Ameeruddin Medical college, Giddalur, Prakasam district, as illegal, arbitrary and violative of Article 30 of the Constitution of India, consequently direct the 1st respondent to grant the minority status certificate to the petitioner proposed institution in pursuance of the application submitted by the petitioner society dated 18.8.2017 in the light of the orders of the Hon'ble Supreme Court in Civil Appeal No.7579/1997 dated 10.1.2001".

Heard the learned counsel for the petitioners and the learned Government Pleader appearing for Respondents. 3.
A counter affidavit has been filed by the Director of Medical Education, State of Andhra Pradesh, Vijayawada, Krishna district, stating that the Vice Principal, Kurnool Medical College, Kurnool submitted report on 24.11.2017 and the same was forwarded to the 1st respondent vide proceedings Rc.No.15709/ME/2017 dated 24.11.2017 for taking necessary action. While referring to the same, it is requested by the learned counsel for the petitioner that the 1st respondent may be directed to take necessary action, as per law.

Recording the same and without expressing any opinion on merits of the matter, the writ petition is disposed of, directing the 1st respondent to
take appropriate action pursuant to the letter of the 2nd respondent in proceedings Rc.No.15709/ME/2017 dated 24.11.2017, strictly in accordance with law, within a period of six weeks from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
