HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.5595 OF 2016 ORDER:

The petitioner, who is A.1 in Crime No.579 of 2015 of III Town Police Station, Rajahmundry, East Godavari District, filed this criminal petition under Sections 437 and 439 of Cr.P.C., seeking release in the above crime registered for the offences punishable under Sections 417, 376, 506, 348, 312 r/w. 34 of IPC and Section 3(1)(i) (V) of SC/ST (POA) Act and Section 6 r/w. Section 5 of POC SO Act, 2012.

When the matter came up for hearing, learned counsel for the petitioner submits that though 90 days period is over from the date of arrest of the petitioner, till date no charge sheet is filed.

The petitioner/A.1 is at liberty to move an appropriate application before the trial Court seeking statutory bail, in which event, the trial Court shall deal with the same and pass appropriate orders in accordance with law.

Subject to the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
