HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39085 of 2017 ORDER:

Heard Sri N.Aswartha Narayana for petitioner. Admittedly, the petitioner does not have required attendance. On account of such circumstance, the respondents have not permitted the petitioner to attend II year I semester examination of B.Tech (Civil) Engineering.

The prayer reads as follows :- " ..... to issue any appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not permitting the petitioner to attend the II year I Semester Examination of B.Tech (Civil) Engineering Course scheduled to be conducted from 22.11.2017 as illegal, arbitrary and unconstitutional and consequently direct the respondent Nos. 1 and 2 to permit the petitioner to attend II year I semester examination of B.Tech (Civil) Engineering....." . Having regard to the admitted circumstances, the petitioner if has 65% attendance, then the discretion available with the respondents can be directed to be exercised. If the attendance fall short of 65% minimum, the law is well settled that the scope of judicial review is not attrac ted. The writ petition fails and is accordingly dismissed. No order as to costs.
