THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.40170 OF 2018 ORDER:

Petitioner claims to be the owner of newly constructed house bearing D.No.1-258 (old D.No.92/1), N.T.R.Complex at Pedaparimi Gram Panchayat, Tulluru Mandal, Guntur District. The limited grievance of the petitioner in the instant Writ Petition is that though the petitioner submitted a representation on 16.07.2018 to assess the house tax payable by her, the same was not done.

When the matter is taken up, learned Standing Counsel would submit that the petitioner is asking the assessment of property tax treating the property as residential house whereas the petitioner has converted a portion of the property for commercial purposes.

It is seen that the petitioner has not mentioned as to how the assessment should be made but was only requesting the Gram Panchayat to assess the house tax and inform her accordingly. If the property is used for commercial purposes, tax can be levied treating the property as commercial property. Therefore, the Gram Panchayat is directed to determine the house tax payable by the petitioner by properly assessing the tax and inform the petitioner the amount of tax payable within three (3) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
