HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Tr.C.M.P.No.437 OF 2016 ORDER:

The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw O.P.No.1136 of 2016 from the file of Judge, Family Court, Ranga Reddy District at L.B. Nagar, and transfer the same to the file of Judge, Family Court, Wanaparthy.

2. Heard Sri G. Madhusudhan Reddy, learned counsel for the petitioner.

3. Though, service on the respondent is completed, none appears for him.

4. The reasons assigned are that the petitioner has got a small child; that she was taking shelter at her parents house, as she was driven out by the respondent from the matrimonial house; that the distance between her residence and the Court at L.B. Nagar, Ranga Reddy District, is 200 KMs. and that she is not only under financial constraint, but it would be inconvenient for her to travel long distance of 200 KMs. without male assistance.

5. The reasons appear to be genuine. More so, none appears for the respondent. Therefore, the request is acceded to.

6. Accordingly, the present transfer petition is allowed. Consequently, O.P.No.1136 of 2016 pending on the file of Judge, Family Court, Ranga Reddy District at L.B. Nagar, is withdrawn and transferred to the file of Judge, Family Court, Wanaparthy, for disposal in accordance with law. The transferee Court shall issue notices to both parties on receipt of the case bundle. Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed.
