THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.815 of 2016 ORDER:

1. This Criminal Petition is filed by the petitioners-Accused Nos.2 and 3 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in Crime No.18 of 2015 on the file of Rajampet Urban Police Station, registered for the offence punishable under Section 420 IPC and Section 3 (1)(x) of the SCs & STs (POA) Act.

2. Heard and perused the material available on record.

3. The 1st petitioner is the mother-in-law of the de facto complainant. The 2nd petitioner is the daughter of the 1st petitioner. It is alleged that they scolded the de facto complainant in the name of her caste.

4. Even though, no serious allegations were made against the petitioners, in case of this nature, there is a bar to grant bail. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners.

However, the petitioners-A2 and A3 are directed to surrender before the Court concerned and move an application for regular bail. On such application being filed, the Court concerned is directed to consider the same on the same day in accordance with law.
