Heard the learned counsel for the petitioner/A.4 and the learned Public Prosecutor.

2. The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, by the petitioner/A.4 seeking enlargement on bail in Crime No.863/20152016 of Prohibition and Excise Station, Visakhapatnam District, registered for the offence punishable under Section 8 (c) read with Section 20 (b) (ii) (c) of the N.D.P.S. Act, 1985.

3. The case of the prosecution is that on credible information with regard to supply of Ganja illegally, the Prohibition and Excise Inspector along with mediators intercepted the vehicle bearing No.AP31-WA T/R 6590 and found the petitioner along with other accused persons in the vehicle. On suspicion, the vehicle was searched and they found 222 kgs of Ganja which was seized under a cover of panchanama. Basing on these allegations, the present case came to be registered.

4. Learned counsel for the petitioner submits that the petitioner is only a driver of the said vehicle and that he is not aware about transportation of Ganja in the said vehicle.

5. Learned Public Prosecutor opposed the same and stated that the petitioner along with others purchased Ganja and the same was being transported by using the vehicle of one M.Satyanarayana, of which the petitioner was the driver of the vehicle and that he is aware about transportation of Ganja in the said vehicle.

6. Having regard to the fact that the petitioner was present in the

vehicle and as he was aware about transportation of Ganja in the said vehicle and since the investigation is still pending, I am not inclined to grant bail to the petitioner for the present.
