THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11872 OF 2018 ORDER:
This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused No.3 for grant of bail in connection with Crime No.116 of 2018 of Markapur Town Police Station, Prakasham District, registered for the offence punishable under Section 306 read with 34 IPC. 2.
Heard the learned counsel for the petitioner/accused No.3, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioner/accused No.3 would submit that the petitioner is a Government employee and he was remanded to judicial custody on 09.10.2018;
that the petitioner/accused No.3 has no role in the subject crime, however, he is falsely implicated in this case and ultimately, prayed to allow the bail application.

On the other hand, the learned Additional Public Prosecutor opposed the grant of bail to the petitioner/accused No.3 contending that there is a suicide note written by the deceased and on the basis of the same, the police registered the present case against this petitioner/accused No.3 along with other accused and ultimately prayed to dismiss the bail application. 5.
As per the investigation and the suicide note purported to have been written by the deceased, this petitioner/accused No.3 along with other accused in this case threatened and beat the
deceased when he made a demand to return Rs.22,00,000/- said to have been given to the petitioner/accused No.3 and other accused persons. There are specific and grave allegations found in the course of investigation against this petitioner/accused No.3. The petitioner is an influenced person. Release of petitioner would hinder the investigation. There is possibility of influencing the witnesses. There are no justifiable grounds to consider the bail application at this stage.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
