HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7956 of 2016 ORDER:

This petition is filed by the petitioner - Accused No.1 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in S.C.No.46 of 2014 on the file of II Additional District and Sessions Judge, Proddatur, for the offences punishable under Sections 147, 148, 342, 364-A, 365, 323, 386, 506, 109 and 307 r/w.149 IPC and 3 & 4 of A.P. Control of Organized Crime Act, 2001. Heard and perused the material available on record. The allegation against the petitioner is that he kidnapped the de facto complainant, with the help of other accused and beat him and took an amount of Rs.3,00,000/- from his family members and released him.

Learned counsel for the petitioner submitted that initially, the petitioner was granted bail and thereafter, the police filed an application for cancellation of bail since the petitioner has not complied with the conditions imposed while granting bail and he was involved in another crime and therefore, his bail was cancelled and since then he has been in judicial custody, and after completion of investigation, police filed charge sheet, which was numbered as S.C. No.46 of 2015 and as the petitioner is in prison for a considerable period, he may be granted bail.

Learned Additional Public Prosecutor submitted that the entire trial is over and the case is posted on 20.07.2016 for examination under Section 313 Cr.P.C.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The trial Court is directed to conclude the trial in SC No.46 of 2014 within a period of one month from today. In case the trial is not concluded by the trial Court within the time stipulated, the petitioner is at liberty to approach this Court.

Accordingly, the Criminal Petition is disposed of. ______________ RAJA ELANGO, J June 24, 2016.
