According to petitioners, land to an extent of Ac.0.11 guntas in Sy.No.173/D; land to an extent of 907.5 square yards in Sy.No.173/A; land to an extent of Ac.1.1055 in Sy.Nos.162/B, 159/C/2, 156/B/3, 155/A/2 and 148/A/3; land to an extent of Ac.2.3100 guntas in Sy.No.173/D; land to an extent of 726 square yards in Sy.No.157, and land to an extent of Ac.1.1525 gunats in Sy.Nos.274/B, 276/A, 277/B, 592/B/2 of Asif Nagar (Bahupeta), Kothapally Mandal, Karimnagar district, belongs to petitioners respectively. Petitioners allege that their land is now being used for widening of road between Karimnagar and Kamareddy from KM 8/400 to 13/400 without following due process as required by law.

The District R&B Officer filed counter-affidavit on behalf of 3rd respondent. According to his averments, the right of way to the R & B Department is of 100 feet extent with 50 feet on either side from the centre of existing road. Work is undertaken to widen the road by fixing boundary stones and constructing side drains and retaining walls wherever necessary on either side of the road. It is also stated that for smooth flow of traffic, horizontal curves are redesigned to avoid accidents and make road traffic worthy. He, therefore, asserted that R&B Department do not require private land as enough land is available for constructing wider road with all amenities and they are not utilizing the land belonging to the petitioners as claimed by them.

Having regard to the above categorical assertion of the 3rd respondent, the apprehension of petitioners that their land is proposed for widening the road is misplaced. Writ Petition is accordingly disposed of. It is needless to observe that if land of petitioners is affected for any purpose in the process of widening of the road, it is open to petitioners to avail appropriate remedy as available in law. Pending miscellaneous petitions shall stand closed.
