THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 36043 of 2017 Order:

This Writ Petition was filed challenging the action of the second respondent in not accepting the tenders of the petitioners on the ground of non-deposit of earnest money deposit (EMD) contrary to G.O.Ms.No.1020, Industries and Commerce (SSI) Department, dated 30.11.1976, while accepting the tenders of the respondents 3 and 4 even though they did not fulfill the turn over aspect as stipulated in the tender document.

When the matter is taken up for consideration, it is represented by the learned counsel for the petitioners that by virtue of the subsequent event during the pendency of the Writ Petition, nothing survives for adjudication in the Writ Petition and the matter has become infructuous. Recording the said submission, the Writ Petition is dismissed as infructuous. However, it is open to the petitioners to approach this Court if any fresh cause of action arises. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
