HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38412 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to call for the records relating to CC No.183 of 2015, on the file of V Special Magistrate, Hasthinapuram, Ranga Reddy District, and quash the same. Heard and perused the record.

After perusing the record, this Court is of the view that this writ petition is not maintainable and therefore, the same is liable to be dismissed.

At this stage, learned counsel for the petitioner submitted that petitioner may be permitted to file a discharge application before the Court below and till disposal of the said discharge application, his presence may be dispensed with before the Court below. Considering the submissions of the learned counsel for the petitioner, the petitioner is permitted to file a discharge application before the Court below, and on such application being filed, the Court below shall consider the same in accordance with law, and till the disposal of the said discharge application, the presence of the petitioner is dispensed with before the Court below.

Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
