THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.964 of 2016 ORDER :

This Criminal Petition is filed by petitioners under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in an unregistered crime.

Heard and perused the material available on record. It is stated that wife of the petitioner No.1 and her father threatened the petitioner No.1 herein that they will file a case against the petitioners herein and get them arrested and spoil the career of the petitioner No.1. Therefore, the petitioners are apprehending that the wife of the petitioner No.1 will file a false complaint against petitioners herein to harass them. Learned Public Prosecutor submitted that no crime was registered against the petitioners.

Considering the above submission made by the learned Public Prosecutor, this Court is not inclined to grant the relief as prayed by petitioners.

However, the respondent-police concerned are directed to follow the procedure and issue notice under Section 41-A Cr.P.C. to petitioners, if any case is registered against them.

Accordingly, the Criminal Petition is disposed of. ______________________ JUSTICE RAJA ELANGO
