The Commissioner of Collegiate Education, State of Andhra Pradesh, Hyderabad and another ..... PETITIONERS AND Ashok Philip and another .....RESPONDENTS Counsel for the Petitioner : G.P.for Services (A.P) Counsel for Respondent No.1 : Mr.C.SAI REDDY The Court made the following:
THE HON'BLE SRI JUSTICE C.V.NAGARJUNA
REDDY & THE HON'BLE SRI JUSTICE M.S.K.JAISWAL WRIT PETITION No.9401 of 2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for a certiorari to quash the order, dated 23.07.2012, in O.A.No.4002 of 2012, and the order, dated 11.02.2016 in C.A.No.1326 of 2012 in O.A.No.4002 of 2012, on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short "the Tribunal").
At the hearing, the learned Government Pleader for Services (AP) submitted that the petitioners are not interested in pressing the first part of the relief, i.e., to quash the order, dated 23.07.2012 in O.A.No.4002 of 2012. She further submitted that interim order, dated 11.02.2016, passed in C.A.No.1326 of 2012 was pending for reporting compliance, and that final arguments in the contempt application were heard on 22.03.2016 and order in the main contempt case itself is reserved.
In the light of these facts, we do not find any reason to entertain this writ petition against the interlocutory order passed in the contempt case. If the petitioners feel aggrieved by the order that may be passed in C.A.No.1326 of 2012, they shall be free to avail appropriate remedy in accordance with law. Subject to the liberty given to the petitioners, as above, this Writ Petition is dismissed. No order as to costs. As a sequel to dismissal of the Writ Petition, WPMP No.11898 of 2016, filed by the petitioners for interim relief, is
disposed of as infructuous.
