CVNR, J CC 484/2016 ORDER:
This contempt case is filed alleging wilful disobedience of order dt.10.12.2015 in W.P. No.35661 of 2015. Mr. P. Sarat Babu, Superintending Engineer, In-charge Commissioner, Karimnagar Municipal Corporation, has filed an affidavit on 28.02.2018 wherein it is stated that after due enquiry the Commissioner of Karimnagar Municipal Corporation has passed detailed orders. A copy of order bearing No.G1/470/2013, dt.23.01.2018 passed in the case of petitioner No.2 has been filed along with the affidavit wherein it is stated that the demolition of the structure raised by petitioner No.2 was made only on the road affected area constructed unauthorizedly and that as per the measurements, existing building after demolition of the encroached portion is at a distance of 50 feet from the middle of the road. It is further stated that as the portion of the structure demolished is purely unauthorized and raised on a part of the road, petitioner No.2 is not entitled to compensation.
By passing the aforementioned orders, the respondent has complied with the order of this Court, though belatedly. The respondent has tendered an unconditional apology for the delay in passing the orders. In the above facts and
CVNR, J CC 484/2016 circumstances of the case, the contempt case is closed, however, with liberty to the petitioners to avail appropriate remedy, if they feel aggrieved by the orders passed by the Commissioner of Karimnagar Municipal Corporation.
