THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.36704 of 2016 O R D E R:

Pursuant to the notice dated 15.10.2016, issued by the respondents alleging violations and making constructions in violation of the sanctioned plan, petitioner submitted a detailed explanation on 21.10.2016. It is the grievance of the petitioner that the respondents even without passing any orders on the explanation submitted by the petitioner in terms of the provisions of the A.P Capital Region Development Authority Act, 2014 (for short, "the Act"), the respondents are threatening the petitioner for demolition of the constructions. Sri D. Ramesh, learned standing counsel for the 2nd respondent submits that only after passing necessary orders on the explanation submitted by the petitioner, if the situation warrants the demolition would be carried out.

Recording the said submissions made on behalf of the 2nd respondent, the writ petition is disposed of with a direction to the respondents not to interfere or not to take any coercive steps with respect to the petitioner's property unless and until the orders are passed on the explanation submitted by the petitioner, in accordance with law. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
