HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.37867 of 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents. 2.

This Writ Petition is filed by the petitioner stating that he has presented sale deed for registration before 4th respondent but 4th respondent is not even receiving the same and is not disclosing any reason why he is not receiving the same.

It is the statutory duty of 4th respondent to receive documents presented by the citizens for the purpose of registration and he cannot refuse to receive them. However, it is open to him to refuse to register the same by passing a reasoned order under Section 71 of the Registration Act, 1908.

Accordingly, the Writ Petition is disposed of directing 4th respondent to receive the document presented by the petitioner for the purpose of registration and consider the same in accordance with the provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908 and consider the same for registration. If he is of the view that it is not liable to be registered, he shall give reasons in writing under Section 71 of the Act by passing an order and communicate the same to the petitioner. This exercise shall be completed within four weeks

MSR,J W.P.No.37867 of 2017 from the date of submission of the document by the petitioner to 4th respondent. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
