HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.11879 of 2018 ORDER:

The petitioner is accused No.1 in crime No.330 of 2018 of Shameerpet Police Station, Cyberabad, registered for the offences punishable under Sections 420, 468 & 471 IPC, outcome of the report of the 2nd respondent-defacto complainant.

Heard learned counsel for the petitioner, learned counsel for the 2nd respondent and also learned Public Prosecutor representing the 1st respondent-State and perused the FIR and the quash petition averments. There is nothing to quash the proceedings from the allegations in the FIR even against the petitioner/A1, but for to say pending investigation the police shall not arrest the petitioner/A1, however it will not prevent the police to secure the presence of the petitioner as and when required for the purpose of investigation and if the petitioner failed to appear, the police shall strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.

With these observations, this Criminal Petition rather than dismissal, disposed of.
