HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.40516 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondents particularly respondent Nos.3 and in interfering with the petitioner's private patta land to an extent of Ac.0.05 cents in Sy.No.207/1A2, situated at Peddakandla Gunta Village and Post, Kondepi Mandal, Prakasam District, and also trying to occupy the same and trying to construct the Anganwadi center without following due process of law. Learned Assistant Government Pleader for Revenue produced written instructions stating that as per RSR of Pedakandlagunta Village, the total land admeasuring an extent of Ac.9.02 cents in S.No.207/1 is classified as Cattle Stand poramboke and the land Ac.0.04 cents in S.No.207/2 and Ac.0.03 cents in S.No.207/3 are classified as Village Site poramboke; that the then Tahsildar, Kondapi has identified the land in S.No.

207/2 and proposed the same for construction of Anganwadi Building; that the Grama Panchayat of Pedakandlagunta Village has conducted a meeting and passed a resolution on 22.06.2016 at 11.

It is also stated that as per the registered sale deed dated 22.06.1985 Sri Dabbugottu Subbaiah who is father of the petitioner herein, has purchased an extent of land Ac.0.05 cents in Sy.No.207/1A2, of Pedakandlagunta Village from Idapalapati Yanadichetti and 6 others; that during the physical inspection made on 26.10.2018, it is revealed that the petitioner constructed a pucca building against the land as purchased by his father which was classified as 'Cattle Stand' vide registered deed dated 22.06.1985 and residing therein; that the land stated by the petitioner herein in this writ petition and the proposed land for construction of Anganwadi building are different; and that the petitioner is not having any right over the proposed land for construction of Anganwadi building.

Recording the aforesaid written instructions submitted by the learned Assistant Government Pleader, the writ petition is disposed of. No order as to costs.
