HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT APPEAL No. 453 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant submits that in view of the judgment of the Supreme Court, dated 21.08.2014, in CA No.7936 of 2014 (2015 (2) ALD 12 (SC)), nothing further survives in the appeal and it may be disposed of as such.

Appeal is dismissed as covered by the aforesaid judgment of the Supreme Court. Dismissal of the writ appeal, however, shall not preclude the appellant from approaching respondent No.4 seeking refund of the amount with interest within a period of two weeks from today. It is open to the appellant to rely upon the aforesaid judgment of the Supreme Court for seeking refund.

If any such application/representation is made, respondent No.4 shall consider the same on merits in accordance with law within a period of six weeks from the date of its presentation.

Consequently, miscellaneous petitions, if any, also stand disposed of.
