HON'BLE SRI JUSTICE CHALLA KODANDA RAM WIRT PETITION No.4887 OF 2016 ORDER:

This Writ Petition is filed seeking Writ of Mandamus declaring the proceedings No.87/2016, dated 02.02.2016 issued by the 3rd respondent-Divisional Panchayat Officer, Chittoor and consequential proceedings of the 4th respondent-The Extension Officer (Panchayat Raj & Rural Development Dept.,) Mandal Praja Parishad Ofice, Vadamalapeta (M), vide Roc.No.18/2016/PR&rd, dated 12.02.2016 as bad, arbitrary and contrary to the G.O.Ms.No.776, dated 31.12.1990 issued by the Government apart from violation of Articles 14, 19, 21 and 300A of Constitution of India.

This matter came up for admission on 17.02.2016 and today when the matter is taken up, the learned Government Pleader for Panchayat Raj, placed on record a communication received from the 2nd respondent-District Panchayat Officer, Chittoor, which reads as under:

"In this connection, it is submitted that actually the Vedullacheruvu of O.B.R.Kandriga Gram Panchayat is not under control of the Gram Panchayat, it relates to the Fisheries Department, Chittoor. Mistakenly the Gram Panchayat has submitted proposals for fixing up of upset price and the Divisional Panchayat Officer, Chittoor has fixed upset price by oversight and also there is no right to the Gram Panchayat and the Extension Officer (PR&RD), Vadamalapeta to issue the notice to Sri Venkateswara Fishermen Cooperative Society Ltd., Vadamalapeta as it is under control of the Fisheries Department. Further after verification of records cancelled the orders of the Divisional Panchayat Officer, Chittor in the reference 3rd cited and notice of the Extension Officer (PR&RD) issued in the reference 2nd cited."

As can be seen from the above the impugned proceedings itself have been withdrawn. In that view of the matter, no further orders as

such are necessary in the Writ Petition.

Accordingly, the Writ Petition is closed. There shall be no order as to costs. Consequently, the miscellaneous petitions pending, if any, shall also stand closed.
