Petitioner claims to be the owner and in occupation of land to an extent of Ac.0.07 cents in Survey No.144-1, Koppigunta Village, Near Gaddenapalli, Katrenakona Mandal, East Godavari District. This Writ Petition is filed alleging that Koppigunta Gram Panchayat, respondent No.6, is preventing the petitioner from using his land admeasuring Ac.0.02 cents in the above survey number and the same is illegal and arbitrary and also seeks a further direction to respondent No.6 not to undertake construction of wall around the land to an extent of Ac.0.02 cents in the above survey number.

Learned Standing Counsel for Gram Panchayat, on instructions, submits that so far Gram Panchayat is neither preventing the petitioner from using the land nor undertaking construction of wall, as contended. He further submits that only on an apprehension, the present Writ Petition is filed. 4.

In view of the same, the Writ Petition is dismissed as premature leaving it open to the petitioner to work out his remedies as and when cause of action arises. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
