ORDER:
Petitioner claims to be the owner of land to an extent of 283 square yards in plot No.1/A in Sy.Nos.278 and 279 of Sai Colony, Nagaram village and Gram Panchayat, Keesara Mandal, MedchalMalkajgiri district. Petitioner alleges that electrical pole is erected on his land without his consent affecting his property and the same is illegal. Photographs are filed to show erection of electrical pole on his land.

On instructions, learned standing counsel submits that electrical pole is not erected by the respondent-Company, and it appears, some private persons have erected the electrical pole on the property belong to the petitioner. He has also circulated two photographs taken by the respondent-company showing erection of electrical pole.

Thus, it appears that electrical pole is erected by some private persons. From the material on record, it is seen that petitioner lodged complaint before the Station House Officer, Police Station Keesara alleging that persons named therein have illegally entered into his plot and tried to erect electrical pole in the plot. From the reading of this complaint also, it is clear that petitioner has grievance against some private persons trespassing into his property.

In view of the categorical assertion of learned standing counsel, on instructions, and that petitioner filed complaint with local police, the allegation that respondent-company is erecting
electrical pole is not valid. Writ Petition is accordingly disposed of, granting liberty to petitioner to work out his remedies against private persons, if so advised.
