THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2514 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in Crime No.54 of 2016 on the file of the P.S., Sadashivapet, Medak District, registered for the offences under Sections 341, 447, 354, 323 and 504 IPC. Heard and perused the material.

It is evident from the record that the petitioners herein lodged a complaint on 07.02.2016 for the occurrence in the same place, whereas the present complaint is filed by the second respondent/complainant for the occurrence occurred in the same place. It is the further case of the petitioners that the complaint lodged by the petitioners herein is not registered, whereas the complaint allegedly lodged by the second respondent/complainant on 09.02.2016 is registered with the influence of the second respondent/complainant.

Considering the facts and circumstances of the case, this Court is of the view that the police are directed to register the complaint, allegedly lodged by the petitioners herein on 07.02.2016 and the same can be investigated into by the police and file final report, if any, in accordance with law. The petitioners are given liberty to challenge the charge sheet, if they are aggrieved over the same, seeking appropriate relief before appropriate forum. The Criminal Petition is accordingly disposed of. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 25.02.2016 pln
