Petitioner has assailed notice dt.24.10.2017 issued to him under Section 7 of the Andhra Pradesh Land Reforms (Ceiling on Agricultural Holdings) Act, 1973 by the 2nd respondent asking the petitioner to show cause, why action should not be initiated under the said provision, within seven days from the date of receipt of said notice. 2.
Though counsel for petitioner sought to contend that the 2nd respondent had no jurisdiction to issue the said notice, I am not able to agree with the said contention, since the Primary Authority under the said Act is 2nd respondent only and not the 3rd respondent.

Therefore, the Writ Petition is disposed of directing the petitioner to submit explanation to the said show cause notice within three (03) weeks from the date of receipt of a copy of this order, and the 2nd respondent is directed to consider the same and pass appropriate orders in accordance with law and communicate the same to the petitioner. If the petitioner does not submit explanation to the said show cause notice within the above stipulated time, it is open for the 2nd respondent to proceed ex parte. However, for a period of four (04) weeks
from today, there shall be stay of dispossession of the petitioner of the subject land.

Miscellaneous petitions, pending if any, shall stand closed.
